Terms of use
These terms are the EULA / terms of use for Apple App Store, Google Play, Microsoft Store, and direct Windows downloads. Privacy is explained separately in the Privacy policy. This is not legal advice.
1. Agreement
By installing or using Pigeon you agree to these terms. If you do not agree, do not use the app. Pigeon is operated by Kastia (“we”). Closed beta software will change, break, or reset. We may wipe beta data.
2. Eligibility
You must be at least 13 years old, or the minimum age in your country if it is higher. You must be able to form a contract. If you use Pigeon for an organization, you confirm you have authority to bind it.
3. The service
Pigeon is a messaging app. Private chats are end-to-end encrypted as described in the privacy policy and technology page. We do not promise that Pigeon is available at all times, that Nearby will reach someone, or that a message will arrive. Voice and video calling are not included in this version.
4. Your account
You are responsible for devices signed in as you and for the content you send. Keep your passphrase and device lock to yourself. You may not impersonate others, probe the service for weaknesses beyond a coordinated report to [email protected], or use Pigeon to break the law. We may suspend or delete an account that violates these terms or that we must remove to comply with law or a store’s rules.
How to delete an account: Settings → Delete account in the app, or the privacy policy if you cannot open Pigeon.
5. License
We grant you a personal, limited, revocable, non-exclusive, non-transferable license to install and use Pigeon on devices you own or control, for your own messaging, in accordance with these terms and the rules of the store you used (if any).
You may not copy the app except as the store or copyright law allows, reverse engineer it except where that restriction is prohibited, rent it, or remove notices. The pigeon mark, name, and app are Kastia’s.
6. Apple (iPhone, iPad, Mac)
If you download Pigeon from the Apple App Store, these additional terms apply. They are meant to satisfy Apple’s Licensed Application End User License Agreement requirements for a custom EULA:
- The license is limited to use on Apple-branded products that you own or control, and as permitted by the App Store Terms of Use, including Family Sharing / volume purchasing where Apple allows it.
- Kastia, not Apple, is responsible for the app and for these terms. Apple has no obligation to provide maintenance or support.
- To the extent a warranty is not effectively disclaimed, Kastia (not Apple) is responsible. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the App Store purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation.
- Kastia, not Apple, is responsible for addressing claims relating to the app, including product liability, consumer-protection, or intellectual-property claims, and any claim that the app fails to conform to a legal or regulatory requirement.
- If a third party claims the app infringes their intellectual property, Kastia, not Apple, is responsible for investigating, defending, settling, and discharging that claim as required by these terms.
- You represent that you are not in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not on a U.S. Government prohibited or restricted party list.
- You must comply with applicable third-party terms when using the app (for example your wireless-data agreement).
- Apple and Apple’s subsidiaries are third-party beneficiaries of these terms. Upon your acceptance, Apple has the right (and will be deemed to have accepted the right) to enforce these terms against you as a third-party beneficiary.
- In-app purchases, if offered, use Apple’s In-App Purchase. Subscriptions auto-renew until cancelled in your Apple ID settings. Refunds are handled by Apple under Apple’s rules.

7. Google (Android and Google Play)
If you install Pigeon from Google Play, you also agree to the Google Play Terms of Service. Paid features, if offered, use Google Play Billing. Refunds and cancellations follow Google’s policies. Kastia, not Google, provides the Pigeon service. Google may process a sign-in token or a push token as described in the privacy policy. You must follow Play’s policies on user-generated content: do not use Pigeon to distribute illegal, exploitative, or malware content.
8. Microsoft (Windows)
The Windows app may be installed from kastia.net or, later, from the Microsoft Store. If you install from the Store, Microsoft’s Store terms also apply, and Store billing (if any) is handled by Microsoft. The desktop installer is provided as-is for closed beta. Windows may warn that the file is unsigned until we complete Authenticode signing; that warning is from Windows, not a claim that the download is from someone else. You are responsible for choosing to run it.
9. Your content
You keep your messages. You grant us only the limited technical right to store and transmit sealed envelopes and account data so the service can function. We cannot grant anyone else the right to read your private chats because we cannot read them. You are responsible for what you send, including that you have the right to send it.
10. Acceptable use
Do not use Pigeon to spam, harass, exploit children, distribute malware, or violate export or sanctions law. Do not interfere with other users or with our servers. Nearby is for local delivery of locked messages among people who opted in — not for tracking strangers.
11. Safety
You can report an account from a profile or a group member in the app. A report opens an email to [email protected] with the username, user id, conversation id, and the reason you typed — not message plaintext, decrypted payloads, or attachments. We cannot read end-to-end encrypted chats, so we cannot moderate private message content. Block is local to this device: we do not sync blocks to our servers, and we cannot remove a private conversation from someone else’s device.
12. Plus and fees
Core private messaging is free. Plus, when sold, is optional capacity. Price and period will be shown in the store listing or in the app before you pay. Encryption is never a paywall. Store taxes and billing are the store’s.
13. Disclaimer
Pigeon is provided “as is” and “as available” during closed beta, without warranties of any kind, to the maximum extent permitted by law. We do not warrant uninterrupted service, error-free Nearby, or that encryption will defeat a compromised or unlocked device. Some places do not allow implied-warranty disclaimers; in those places, we disclaim only as far as the law allows, and any required warranty lasts only as long as the law requires.
14. Liability
To the maximum extent permitted by law, Kastia is not liable for lost profits, lost data, or indirect or consequential damages, or for an amount greater than the fees you paid us for Pigeon in the 12 months before the claim (or fifty U.S. dollars if you paid nothing). This does not limit liability that the law says cannot be limited, including for fraud or for death or personal injury caused by negligence where such a limit is forbidden.
15. Changes and termination
We may update these terms. The date at the top will change. If you keep using Pigeon after an update, the new terms apply. We may stop offering beta access. You may stop using Pigeon and delete your account at any time.
